Terms of Use
Welcome to Glo. These Terms of Use (“Terms”) govern your access to and use of the Glo website, mobile applications, and related services (collectively, the “Services”), operated by Glo Health, Inc. (“Glo,” “we,” “us,” or “our”).
By creating an account, browsing our website, or using any part of the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Services.
Please read these Terms carefully. They contain important information about your legal rights, remedies, and obligations, including a binding arbitration provision and class action waiver described in Section 14.
1. Acceptance of Terms
By accessing or using the Services in any way — including browsing our website, creating an account, completing an intake questionnaire, or purchasing a product or subscription — you confirm that you have read, understood, and agree to be bound by these Terms, as well as any additional terms, policies, or guidelines referenced herein or provided to you in connection with specific Services.
If you are using the Services on behalf of another person (for example, as a caregiver), you represent that you have the authority to bind that person to these Terms, and “you” refers to both you and that individual.
2. Eligibility
To use the Services, you must:
- Be at least 18 years of age, or the age of majority in your jurisdiction;
- Be a resident of, and physically located in, a state or territory where Glo’s services are offered;
- Be legally capable of entering into a binding contract; and
- Not be prohibited from using the Services under the laws of your jurisdiction.
By using the Services, you represent and warrant that you meet all of the eligibility requirements above. Glo reserves the right to verify your eligibility at any time and to refuse, suspend, or terminate access to the Services if eligibility cannot be confirmed.
3. Accounts & Registration
3.1 Account Creation
To access certain features of the Services, you must create an account by providing accurate, current, and complete information, including your name, email address, date of birth, and other identifying details as requested. You agree to promptly update your information if it changes.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, whether or not authorized by you. You agree to notify us immediately at security@glo.com if you become aware of any unauthorized access to or use of your account.
3.3 One Account Per Person
Each individual may maintain only one active account. Creating multiple accounts to circumvent restrictions, eligibility requirements, or pricing is prohibited and may result in suspension of all associated accounts.
4. Description of Services
Glo connects users with independent, licensed healthcare providers (“Providers”) who offer telehealth consultations related to weight management, metabolic health, and other wellness areas. Through the Services, you may be able to:
- Complete online health questionnaires and intake forms;
- Communicate with Providers via secure messaging or video consultation;
- Receive prescriptions for FDA-approved or compounded medications, if deemed clinically appropriate by a Provider;
- Access educational content, calculators, and wellness tools; and
- Manage subscriptions, orders, and shipments related to your treatment plan.
Glo is a technology platform that facilitates access to independent healthcare Providers and licensed pharmacies. Glo itself does not practice medicine, does not provide medical advice, and does not guarantee that any Provider will determine that treatment is appropriate for you.
5. Medical & Telehealth Disclaimer
5.1 Not a Substitute for Emergency Care
The Services are not intended for use in medical emergencies. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately. Do not rely on the Services for urgent or emergency medical needs.
5.2 Independent Clinical Judgment
All medical decisions, including whether to prescribe medication, are made solely by independent, licensed Providers based on their own clinical judgment. Glo does not influence, direct, or guarantee any specific treatment outcome, prescription, or diagnosis. A Provider may determine, after reviewing your information, that the Services or a particular treatment are not appropriate for you.
5.3 Accuracy of Health Information
You agree to provide accurate, complete, and truthful information about your health history, current medications, allergies, and symptoms. Providing false or misleading information may result in inappropriate treatment recommendations and may be grounds for immediate termination of your account.
5.4 Educational Content
Any articles, calculators (including but not limited to BMI, BMR, TDEE, calorie, and protein calculators), or other informational content available through the Services are provided for general educational purposes only. They are not a substitute for individualized medical advice and should not be used to diagnose or treat any health condition.
6. Payments, Subscriptions & Refunds
6.1 Pricing
Prices for consultations, medications, and memberships are displayed at the time of purchase and may include the cost of a clinical consultation, prescription medication, and shipping, where applicable. Prices are subject to change, and we will make reasonable efforts to notify you of material price changes affecting an active subscription before they take effect.
6.2 Subscriptions & Auto-Renewal
Certain Services are offered on a recurring subscription basis (e.g., monthly or quarterly medication refills). By enrolling in a subscription, you authorize Glo to automatically charge your designated payment method on a recurring basis until you cancel. You may cancel your subscription at any time through your account settings or by contacting support@glo.com, subject to any applicable notice periods described at checkout.
6.3 Refunds
Due to the nature of prescription medications, completed medication orders are generally non-refundable once shipped, except as required by law or as expressly stated in our Returns & Refunds Policy. Consultation fees may be refundable if a Provider determines that no treatment can be prescribed, in accordance with our refund policy.
6.4 Insurance
Where applicable, Glo may assist in submitting claims to your health insurance plan. Glo does not guarantee coverage, reimbursement, or any specific out-of-pocket cost, as these are determined solely by your insurance provider and plan terms.
7. User Conduct
When using the Services, you agree not to:
- Provide false, inaccurate, or misleading information, including regarding your identity, age, location, or medical history;
- Use the Services for any unlawful purpose or in violation of any applicable local, state, federal, or international law;
- Resell, redistribute, or share access to your account, prescriptions, or medications with any other person;
- Attempt to gain unauthorized access to any portion of the Services, other accounts, or related systems or networks;
- Use any automated system, including bots, scrapers, or spiders, to access the Services without our prior written permission;
- Upload or transmit viruses, malware, or any other malicious code; or
- Harass, abuse, or harm another user, Provider, or member of the Glo team.
Violation of this section may result in immediate suspension or termination of your account, in addition to any other remedies available to Glo under law.
8. Intellectual Property
All content available through the Services — including text, graphics, logos, icons, images, audio clips, software, calculators, and the compilation thereof (collectively, the “Content”) — is the property of Glo or its licensors and is protected by copyright, trademark, and other intellectual property laws.
Subject to your compliance with these Terms, Glo grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any Content without our prior written consent.
“Glo” and all related names, logos, and marks are trademarks of Glo Health, Inc. You may not use these marks without our prior written permission.
9. Third-Party Services
The Services may contain links to, or integrate with, third-party websites, products, or services that are not owned or controlled by Glo, including but not limited to pharmacies, laboratories, payment processors, and shipping carriers. Glo is not responsible for the content, privacy practices, or actions of any third party. Your use of any third-party service is governed by that party’s own terms and policies.
10. Disclaimers
THE SERVICES, INCLUDING ALL CONTENT, FEATURES, AND FUNCTIONALITY, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
GLO DOES NOT WARRANT THAT ANY MEDICATION, TREATMENT, OR RECOMMENDATION PROVIDED THROUGH THE SERVICES WILL BE EFFECTIVE FOR YOUR PARTICULAR CONDITION OR THAT YOU WILL ACHIEVE ANY SPECIFIC RESULT, INCLUDING WITH RESPECT TO WEIGHT LOSS.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF GLO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL GLO’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO GLO IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless Glo, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with: (a) your access to or use of the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property or privacy right; or (d) any inaccurate or false information you provide to Glo or a Provider.
13. Termination
You may stop using the Services and close your account at any time by contacting support@glo.com. Glo may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms, provided false information, or engaged in conduct that we determine, in our sole discretion, to be harmful to Glo, other users, or Providers.
Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability — will survive.
14. Dispute Resolution
14.1 Binding Arbitration
Except for disputes that qualify for small claims court, any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration administered by a recognized arbitration organization, rather than in court, except that either party may bring an individual action in small claims court.
14.2 Class Action Waiver
YOU AND GLO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Glo agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.
14.3 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles, except to the extent governed by the Federal Arbitration Act.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, Services, or legal requirements. If we make material changes, we will notify you by posting a notice on our website, sending an email to the address associated with your account, or through other reasonable means, prior to the changes taking effect. Your continued use of the Services after the effective date of any revised Terms constitutes your acceptance of those changes.
